Today, the Department of Justice's Civil Rights Division issued a letter to the Wisconsin Elections Commission. The letter addresses the commission's failure to provide a complaint process or hearing for voters in Wisconsin, which is required under the Help America Vote Act (HAVA). According to the letter, the commission did not meet HAVA's requirement for a state-based administrative complaint procedure.
The department emphasized that compliance with federal election laws is mandatory and that receiving federal funds under HAVA depends on adherence to these laws. "Election integrity and compliance with federal elections laws are essential to protect our constitutional republic," the letter states. It further highlights that Wisconsin's lack of recourse for complainants reporting voting violations constitutes a significant breach of federal law and undermines public confidence.
Assistant Attorney General Harmeet K. Dhillon of the Justice Department’s Civil Rights Division commented, "Courts across the land, including our highest court, have repeatedly defended measures to ensure election integrity." She added, "We have made it our highest priority to identify jurisdictions that fail to follow our elections laws and vigorously enforce the law by all means available."
The letter also informs the U.S. Election Assistance Commission about Wisconsin's actions and suggests withholding federal funds from Wisconsin due to its violation of HAVA.
