The Wisconsin Institute for Law & Liberty (WILL) has voiced strong criticism against the new Title IX rules introduced by the Biden Administration, labeling them as detrimental to the rights and safety of women and girls across the nation. Cory Brewer, Education Counsel at WILL, expressed his concerns, stating, “Title IX was meant to protect the rights, safety, and well-being of women and girls in educational activities. But these new regulations turn the intent of the law on its head...Women and girls across our country are being blatantly disrespected."
The organization's stance stems from a previous incident at the Sun Prairie Area School District (SPASD) involving an 18-year-old male student who identified as transgender and showered completely undressed next to female students in the girls’ locker room. Following this, WILL filed a complaint which led to a Title IX investigation by the U.S. Department of Education Office of Civil Rights. WILL is apprehensive about the inclusion of gender identity in sex discrimination and the potential outcomes of this investigation.
Although the final regulations are set to take effect on August 1, 2024, WILL foresees significant legal challenges ahead for these changes and is closely monitoring the situation. Additionally, the organization highlighted the lack of clarity for female athletes in the new regulations, especially concerning boys competing in girls’ sports. WILL anticipates that this issue will escalate and eventually reach the United States Supreme Court.
As the debate over the new Title IX changes continues, WILL remains committed to advocating for the rights and dignity of all students, particularly women and girls, in the educational system.
