Attorney General Josh Kaul, along with a coalition of 23 attorneys general, has filed motions in the ongoing lawsuit NY v. Trump. The lawsuit challenges actions by former President Donald Trump, the Office of Management and Budget (OMB), and federal agencies regarding the pause of nearly $3 trillion in federal assistance funding. This funding is crucial for state programs that provide essential services to the public.
The coalition's motion for a preliminary injunction aims to stop the Trump Administration's alleged funding freeze, which they argue poses significant threats to access to food, healthcare, and other critical services provided by states. Attorney General Kaul emphasized the need for compliance with a court order blocking this freeze, stating, "We’re asking the court to bring the Trump administration fully into compliance with the order blocking the freeze and to keep the freeze blocked pending the court’s final ruling."
Despite a Temporary Restraining Order (TRO) being in place, evidence suggests that disruptions continue in disbursements under both the Inflation Reduction Act (IRA) and Infrastructure Investment and Jobs Act (IIJA). These acts are vital for enhancing domestic energy security, reducing costs, diversifying resources, rebuilding manufacturing economies, modernizing infrastructure, creating jobs, and reducing pollution.
The coalition seeks enforcement of these funds' allocation as required by statute to prevent harm to states reliant on this support. The motion aims for swift disbursement so states can utilize these funds for residents' health and safety.
Attorney General Kaul is joined by his counterparts from Arizona, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, New York, Nevada, North Carolina, New Jersey, New Mexico, Oregon, Rhode Island, Vermont, and Washington in filing these motions.
