Tom Tiffany, representing Wisconsin's 7th Congressional District, has commented on what he perceives as a double standard in the Democratic response to crimes committed by undocumented immigrants. He made these remarks on the social media platform X.
"Democrats are more outraged over an MS-13 gang member's deportation than they ever were over innocent Americans killed by illegal aliens under Biden," said Tiffany, Representative. "It shows where their true priorities lie."
In March 2025, Kilmar Abrego Garcia was deported to El Salvador despite a Supreme Court order preventing his removal. According to ABC News and the Associated Press, U.S. officials identified him as an MS-13 gang member based on contested claims such as an anonymous tip and clothing style. Two federal judges later found these claims unsubstantiated. El Salvador’s President Nayib Bukele refused to return Garcia due to national custody laws, leading to bipartisan concerns over due process and executive defiance of judicial authority.
According to a 2024 report by the House Homeland Security Committee, U.S. Immigration and Customs Enforcement had nearly 650,000 undocumented immigrants with criminal records on its Non-Detained Docket. This means they had been released into the U.S. despite previous criminal charges or convictions. The report, cited by Committee Chair Mark Green, increased scrutiny of the Biden administration’s enforcement priorities amid broader immigration debates.
In 2025, more than 200 migrants, including alleged MS-13 gang members, were deported to El Salvador’s high-security CECOT prison under the Alien Enemies Act—legislation last used during World War II. CBS News and NPR reported that this law was invoked by the Trump administration to expedite deportations, including that of Kilmar Abrego Garcia, whose removal had been blocked by court order. The move raised legal and human rights concerns regarding due process and executive authority.
Tiffany has represented Wisconsin’s 7th District in the U.S. House since 2020 and serves on the House Judiciary Committee and its subcommittees on immigration and crime. According to Congress.gov and PBS Wisconsin, he advocates for strict immigration enforcement and increased border security while opposing state policies that limit cooperation with federal authorities—positions consistent with broader Republican priorities on immigration reform.
