Jay Weber, a talk show host of WISN-Milwaukee, said that a federal judge's order preventing the deportation of Kilmar Abrego Garcia undermines clear State Department authority. The statement was made on X.
"ICE should collect him and hold him until his court date and/or deport him anyway if they have cause," said Weber, Talkshow Host. "This judge is stepping on clear State Dept authority."
The case of Kilmar Abrego Garcia gained national attention in June 2024 after a federal judge in Wisconsin ordered his release from Immigration and Customs Enforcement (ICE) detention due to due process violations and delays in his deportation. This prompted ICE to review its policies on prolonged detentions. As reported by the Milwaukee Journal Sentinel, the case highlights growing tensions between federal courts, immigration enforcement, and advocates over detainee rights.
According to the Transactional Records Access Clearinghouse at Syracuse University, federal courts intervened in 2,190 deportation proceedings nationwide in 2023. These interventions most commonly involved issuing stays or ordering detainee releases due to legal and procedural concerns.
A 2024 Government Accountability Office report found that after court-ordered releases, ICE pursued enforcement actions in about 64% of cases within six months. However, re-detention or deportation resulted in less than half of these cases, revealing mixed outcomes post-intervention.
